1. Introduction
Pretii is a loyalty platform offered as software as a service (the "Platform"). It lets agencies and other partners (the "Partner") and shops (the "Shop") run loyalty and rewards programmes for their customers (the "Customer") through web and mobile apps and Wallet cards.
These terms govern access to and use of the Platform. By creating an account, downloading the apps or using the service, you accept these terms. The Platform is provided by LOGICAL DESIGN E.I.R.L. ("Pretii"), registered in Peru (RUC 20545331951), Av. Arequipa 2447 Dpto. 409, Lince, Lima, Peru. Contact: [email protected].
If you don't agree with any of these terms, please don't use the Platform or download the apps.
2. Using the Platform
The Platform is made up of:
- the customer app for Android and iOS, and the customer web app;
- the staff app for Android and iOS;
- the admin panel for each Shop;
- the partner dashboard, in the Partner plan;
- loyalty cards in Apple Wallet and Google Wallet, on the plans that include them.
How programmes work
- Separate balances: a Customer can earn points at several Shops. Points and redemptions are kept separately for each Shop.
- Personal points: points belong to one Customer and can't be transferred to another account.
- Rewards: each Shop alone defines, manages and gives out the rewards it offers. Pretii is not responsible for rewards a Shop doesn't give.
Restrictions
Partners and Shops agree not to do, or let others do, any of the following:
- reverse engineer the Platform or try to discover its source code;
- register people under 18 on the shared Pretii platform, or minors without the consent the law requires on a platform with their own brand (section 8);
- upload content that promotes illegal products or services;
- use images, trademarks or content protected by copyright without permission.
3. Partner plan
- Your platform: the Partner gets a platform with its own name and logo, a partner dashboard and as many Shops as it wants.
- Your Shops: the Partner chooses the plan and the price for each of its Shops and bills them directly. The relationship between the Partner and its Shops, including what each Shop pays, is the Partner's responsibility.
- Fees: a setup fee paid once, which depends on the apps chosen, and a monthly fee that includes 500 redemptions a month that carry over. Extra redemption packs add to the plan and don't expire. Current prices are on the pricing page.
- Free months: when a promotion includes free months, they start when the Partner's platform is ready.
- Payment, suspension and deletion: the conditions in section 4 apply.
4. Platforms with your own brand
These conditions apply to the Partner plan and to the own-brand plans for Shops (Web + Wallet, and Web + mobile apps):
- No long-term contract: the service stays active while the monthly fee is paid.
- Suspension for non-payment: if a monthly payment is not received, the platform is switched off automatically on the third day after the due date.
- Reactivation: reactivating a platform suspended for non-payment has an extra administrative fee.
- Deletion: 3 months after a platform is switched off for non-payment, it is deleted with all its data. Within that time you can ask to reactivate it, or to switch it on briefly to download your customer list.
- Data protection: the owner of the platform is the controller of the personal data on it, including its Customers' accounts, and must publish its own privacy policy and meet the registration duties of its country. Pretii acts as a processor under section 8.
- Not included in the monthly fee: new features built to order, changes to the source code requested by the client, and updates forced by policy changes in third-party stores (Google Play, App Store, Huawei AppGallery). These have an extra technical cost.
5. Closing an account
A Shop on the shared Pretii platform can delete its account from the admin panel, under Settings. Deletion is immediate and can't be undone: it removes the Shop's information, users, rewards, redemptions, purchases and its Customers' records in its programme. Before deleting it, the Shop can download its customer list from the Customers section of the panel. Accounts that Customers created in the Pretii app or on pretii.app are not deleted, because they belong to each Customer.
Payments stay recorded with the payment provider used (PayPal, Openpay or dLocal Go), and invoices are issued with SUNAT, the Peruvian tax authority. They are kept outside the Platform for the period tax law requires.
Inactive accounts: we may switch off or delete Shop accounts with no activity for 6 months or more, after notice to the registered email.
6. Billing and international taxes (reverse charge)
For payments from outside Peru we apply the reverse charge mechanism. Our invoices are issued without local taxes (such as Peruvian IGV), and the client declares and pays the taxes due in its own country.
To get this treatment and a valid invoice, the client must give us at payment:
- Tax number: a valid tax registration number (VAT number, EIN, ABN or the equivalent in its country);
- Legal name: the full legal name of the company or person;
- Tax address: a complete, verifiable registered address.
If this information is not true and complete, Pretii may add the local taxes of its own jurisdiction to the invoice, or suspend the service until the tax information is correct.
7. Refunds
Once a payment for the service (monthly or yearly) is made, we don't give full or partial refunds if you cancel before the end of the period paid for. Server resources and third-party licences are committed and paid for from the start of each period.
8. Customers' personal data (processing on your behalf)
8.1 Roles
The Shop is the controller of its Customers' personal data: those who join its programme and those it loads into the Platform (from the panel, by file import, through the API or through integrations such as Shopify). In the Partner plan, the Partner is responsible for the personal data on its platform towards its Shops and their Customers, and must have its own agreements with its Shops. Pretii processes that data as a processor, on behalf of the Partner or the Shop.
On the shared Pretii platform, the account a Customer creates in the Pretii app or on pretii.app is Pretii's responsibility, under the Pretii app privacy policy.
8.2 Duties of the Partner and the Shop
- Have a legal basis, usually consent, before registering or loading Customers' data, and tell them what the data is used for and that Pretii processes it on their behalf.
- Load only the data the programme needs, and no sensitive data (health, racial origin, political or religious views, biometric data, among others).
- Not register people under 18 on the shared Pretii platform. On a platform with its own brand, if it accepts minors, have the consent the law requires.
- Answer Customers' requests for access, correction, erasure, objection and portability. The Platform lets you edit, export and delete customers from the panel.
- Meet the data protection registration duties of its own country.
8.3 Pretii's duties as processor
- Process Customers' data only to provide the Platform and as instructed by the Partner or the Shop, through the panel settings. Pretii doesn't sell the data or use it for its own purposes.
- Make sure its staff keep that data confidential.
- Apply the security measures described in the privacy policy.
- Use only the providers (sub-processors) listed in the privacy policy, which also describes international transfers. If they change, Pretii updates the policy.
- Tell the Partner or the Shop without undue delay about any security incident affecting its Customers' data.
- Pass on to the Partner or the Shop any rights requests it receives about their programme's data.
- Delete the programme's data when the service ends, as in sections 4 and 5.
8.4 Privacy policy
Everything else about personal data is governed by our privacy policy, which is part of these terms.
9. Changes to these terms
We may update these terms to reflect changes in the Platform or in the law. We will tell you about important changes, but please check this page from time to time. Continuing to use the Platform means you accept the new terms.
